Terms of Use & Participation Agreement

Acceptance of Terms

Participation in the Towson United Boys Soccer ("TUBS") Skills Mastery App (the "App") is expressly conditioned upon acceptance of these Terms of Use & Participation Agreement (the "Terms"). By creating an account, accessing, using, or participating in the App, you acknowledge that you have read, understand, and agree to be bound by these Terms and all incorporated policies, terms, acknowledgments, consents, releases, and waivers.

These Terms are supplemental to, and shall be read together with, the Terms & Conditions for Participation in Towson United Boys Soccer. In the event of a conflict, the TUBS Terms & Conditions for Participation shall control.

Eligibility and Parent Consent

The App is intended solely for use by registered TUBS players and their parents or legal guardians. By creating an account for a minor Participant, the parent or legal guardian represents and warrants that he or she has the legal authority to act on behalf of the Participant and consents to the Participant's use of the App. The parent or legal guardian is responsible for ensuring that all account information is accurate, current, and complete.

Purpose of the App

The App is intended solely as an educational and player-development resource designed to encourage technical skill development, independent practice, and engagement with TUBS training initiatives.

The App is supplemental to, and not a substitute for, team training sessions, coaching instruction, professional instruction, medical advice, athletic training, fitness training, or other services.

Voluntary Participation

Participation in the App is voluntary. Use of the App, participation in App activities, completion of skill challenges, earning of points, badges, rankings, or other recognition shall not guarantee or influence team selection, roster placement, playing time, position assignment, promotion, or any other soccer-related opportunity within TUBS. Participation in the App is NOT REQUIRED for participation in TUBS programs.

Assumption of Risk

The Participant and parent or legal guardian acknowledge that soccer-related activities, including activities encouraged, demonstrated, tracked, or promoted through the App, involve inherent risks, including but not limited to falls, collisions, overexertion, equipment-related injuries, and other risks of bodily injury.

Participation in any activity described, demonstrated, or encouraged through the App is voluntary and undertaken at the Participant's own risk.

The Waiver of Liability & Assumption of Risk contained in the TUBS Terms & Conditions for Participation is incorporated herein by reference and shall apply to all App-related activities to the fullest extent permitted by law.

Medical and Health Disclaimer

TUBS does not provide medical, physical therapy, athletic training, fitness, rehabilitation, or healthcare services through the App. The App is intended solely for informational and educational purposes. Participants should discontinue any activity that causes pain, discomfort, dizziness, illness, injury, or other adverse symptoms and should consult a physician or qualified healthcare professional regarding any medical concerns.

Account Responsibilities

Users shall provide accurate information when creating and maintaining accounts. Each Participant may maintain only one account unless otherwise authorized by TUBS. Users are responsible for maintaining the confidentiality of account credentials and for all activities occurring under their accounts. Users shall promptly notify TUBS of any suspected unauthorized access to or use of their account. TUBS may require account verification, password resets, account updates, or other security measures as a condition of continued access to the App.

Points, Badges, Rankings, and Leaderboards

The App may include points, badges, rankings, leaderboards, achievements, streaks, rewards, or similar engagement features. Such features are intended solely for recreational, motivational, educational, and player-development purposes. TUBS reserves the right to modify, suspend, reset, recalculate, remove, or discontinue any scoring system, ranking methodology, leaderboard, challenge, badge, reward, achievement, or participation metric at any time without notice. Points, badges, rankings, and achievements have no cash value and may not be transferred, exchanged, sold, redeemed, or converted into any monetary benefit. Users acknowledge and agree that participation information, rankings, points, badges, achievements, team affiliation, and leaderboard positions may be visible to other authorized App users and may be displayed in App features and club communications. Submission of a video, photograph, recording, or other User Content does not guarantee the award of points, badges, rankings, achievements, or challenge credit. TUBS reserves sole discretion regarding verification and crediting of participation activities.

Player Conduct & Sportsmanship

All users shall comply with the TUBS Code of Conduct, which is incorporated herein by reference. Participants shall honestly report activities and shall not engage in cheating, manipulation, falsification of participation records, unauthorized account access, exploitation of software errors, or other conduct intended to gain an unfair advantage.

Participants shall treat other users with respect and sportsmanship at all times.

Content & Intellectual Property

All App content, including but not limited to software, videos, graphics, images, training materials, curricula, skill demonstrations, text, logos, trademarks, rankings, leaderboards, and related materials are owned by or licensed to TUBS and are protected by applicable intellectual property laws. No content may be copied, reproduced, distributed, modified, publicly displayed, commercially exploited, or otherwise used without the prior written consent of TUBS.

Ownership of the App

The App, including all software, content, curricula, challenges, leaderboards, databases, and related materials, is owned by or operated on behalf of TUBS. Nothing in these Terms transfers any ownership rights to users. TUBS reserves all rights not expressly granted herein.

User-Generated Content & Media Release

I understand, acknowledge, and agree that my minor child(ren) may be photographed, filmed, recorded, or otherwise captured through the App and during Towson Recreation Council's Towson United Boys Soccer ("TUBS") activities, including practices, games, tournaments, camps, clinics, meetings, skill challenges, App-related activities, and other club-related events.

To the extent the App permits users to upload, submit, post, transmit, or otherwise provide photographs, videos, recordings, comments, feedback, skill demonstrations, challenge submissions, leaderboard information, or other content (collectively, "User Content"), I grant permission to TUBS, Towson Recreation Council, and their sponsors, partners, affiliates, authorized photographers, videographers, contractors, media providers, service providers, and successors and assigns to capture, receive, use, reproduce, modify, edit, combine, publish, display, distribute, transmit, create derivative works from, and otherwise use such User Content, as well as my child's image, likeness, name, voice, photographs, video recordings, and other recordings, in local, print, online, digital, mobile, and social media formats, including websites, applications, social media platforms, newsletters, advertisements, promotional materials, highlight videos, leaderboards, rankings, achievement displays, educational materials, fundraising materials, and other communications.

Such use may be for advertising, marketing, promotional, editorial, educational, archival, fundraising, program administration, player development, recognition, leaderboard display, achievement tracking, historical, or other program-related purposes associated with TUBS, youth sports media services, or operation of the App.

I further grant permission for TUBS' authorized photographers, videographers, media providers, contractors, and service providers to use such photographs, videos, recordings, or User Content for their professional portfolio, website, social media, sample galleries, advertising, marketing, promotional, editorial, and business purposes related to youth sports photography, videography, software, technology, and media services.

I understand and agree that such materials may be edited, copied, modified, combined with other materials, published, displayed, distributed, or otherwise used without further notice, inspection, or approval and that no compensation, royalties, fees, prizes, or other consideration will be provided for the use of my child's image, likeness, name, voice, photographs, videos, recordings, or User Content.

To the fullest extent permitted by law, I grant TUBS a perpetual, worldwide, non-exclusive, irrevocable, transferable, sublicensable, royalty-free license to use, reproduce, modify, adapt, publish, distribute, display, perform, store, archive, and otherwise utilize User Content for the purposes described herein.

I represent and warrant that any User Content submitted through the App is owned by me or my child, that any individual appearing in submitted User Content has consented to such appearance, or that I otherwise possess all necessary rights and permissions to submit such content and grant the rights described in this section.

I further understand and acknowledge that TUBS and Towson Recreation Council do not control and are not responsible for the subsequent sharing, reposting, downloading, redistribution, copying, or misuse of photographs, videos, recordings, leaderboard information, or other content once published online, through social media, or through other digital platforms.

TUBS may review User Content for administrative, educational, safety, verification, or program-related purposes. However, TUBS does not guarantee that all User Content will be reviewed, monitored, screened, verified, or approved prior to submission, posting, storage, display, or use. TUBS reserves the right, but shall have no obligation, to monitor, review, screen, verify, edit, remove, restrict, reject, or disregard any User Content at any time and for any reason. TUBS assumes no responsibility or liability for User Content submitted by users.

Video Submission Requirements

Any video, photograph, recording, or other content submitted through the App must be related to App activities or skill challenges and may not contain inappropriate, offensive, discriminatory, threatening, harassing, unlawful, sexually explicit, or otherwise improper content. User Content may not infringe upon the intellectual property, privacy, publicity, or other rights of any third party and must comply with all applicable laws and TUBS policies. Users may submit only content that they own or have permission to submit. TUBS reserves the right to remove, restrict, reject, or disregard any submitted content that violates these requirements or that TUBS determines is inconsistent with the purposes of the App.

Privacy and Data Collection

Use of the App is subject to the TUBS Privacy Policy, which is incorporated herein by reference and forms part of these Terms. TUBS may collect information including, but not limited to, player names, team affiliations, age groups, participation history, skill-completion data, points, rankings, achievements, account information, and related operational data for purposes of administering the App and supporting TUBS programming.

Communications and Notifications

By creating an account, users consent to receive App-related communications, including emails, notifications, reminders, leaderboard updates, challenge announcements, technical notices, administrative messages, and other communications relating to App participation.

Third-Party Services

TUBS may utilize third-party software, hosting providers, cloud services, communication providers, data storage providers, and technology vendors in connection with the App. TUBS shall not be responsible for interruptions, outages, delays, errors, security incidents, or failures attributable to such third-party providers.

Modification of the App

TUBS reserves the right to modify, suspend, restrict, discontinue, or remove any portion of the App at any time and for any reason without liability.

Account Suspension or Termination

TUBS reserves the right to suspend, restrict, terminate, or remove access to any account for violations of these Terms, the TUBS Code of Conduct, misuse of the App, cheating, inappropriate conduct, or any other conduct deemed detrimental to TUBS, its participants, or its programs.

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TUBS MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE AVAILABILITY, FUNCTIONALITY, PERFORMANCE, ACCURACY, SECURITY, RELIABILITY, OR FITNESS OF THE APP FOR ANY PARTICULAR PURPOSE, NOR DOES TUBS GUARANTEE ANY SPECIFIC ATHLETIC, DEVELOPMENTAL, OR TRAINING OUTCOME.

Limitation of Liability

To the fullest extent permitted by law, TUBS, Towson Recreation Council, and their respective employees, directors, officers, volunteers, members, agents, contractors, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the use of, inability to use, or participation in the App.

Indemnification

The user agrees, on behalf of himself, herself, and the Participant, to indemnify, defend, and hold harmless TUBS, Towson Recreation Council, and their respective employees, directors, officers, volunteers, members, agents, contractors, and representatives from any claims, demands, damages, losses, liabilities, costs, or expenses arising out of misuse of the App or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland without regard to conflict-of-law principles.

Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

General Terms

TUBS shall not be responsible or liable for any delay, interruption, failure, or inability to provide access to the App, App features, communications, data, or related services due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, severe weather, emergencies, power outages, internet or telecommunications failures, cyber incidents, technology failures, third-party service interruptions, governmental actions, or other events outside TUBS' reasonable control.

The failure of TUBS to enforce any provision of these Terms, exercise any right, or take action in response to any violation shall not constitute a waiver of TUBS' right to enforce such provision, exercise such right, or take action in the future.

These Terms, together with the Privacy Policy and all policies, agreements, acknowledgments, consents, releases, and waivers incorporated by reference, constitute the entire agreement between the user, Participant, and TUBS regarding use of the App and supersede any prior discussions, understandings, or communications regarding the App.
